Kirby & Holt - North Carolina Birth Injuries Attorneys
Since the firm was founded, the attorneys of Kirby & Holt have successfully handled more birth injury cases than any other firm in North Carolina. In one case, we won the largest medical malpractice jury verdict in North Carolina history. In another case, we negotiated the largest birth injury settlement in state history. Both of these cases involved cerebral palsy caused by negligence on the part of the obstetrician, other members of the obstetric team or the hospital. Cerebral palsy is one of the most severe and recognizable consequences of delivery room negligence, but other permanent or life-threatening conditions can jeopardize either the infant or the mother. Some of these include:
- Fetal distress or trauma, caused by the failure to properly monitor vital signs or respond to sudden changes in heart rate or blood oxygen levels
- Kenicterus, or jaundice, which improperly treated can lead to brain damage
- Cephalohematoma, or bleeding in the brain, caused by improper use of the forceps on the fetus's head
- Uterine ruptures from negligent c-section procedures or ruptures of previous uterine scars; the fetus can suffer brain damage if protruding into the abdominal cavity
When we investigate a birth injury case for litigation, we work closely with medical experts to determine the likelihood that a child's condition was caused by negligent care by the attending physician or obstetric staff. We also develop a specific care plan of the costs of treating and caring for the injured child during his or her lifetime through the work of economic and rehabilitation experts.
Our commitment to children doesnt stop at the courthouse steps. We formed the Kirby & Holt Foundation to give back to our community, often in the form of projects to benefit children, and we are longstanding and substantial supporters of Easter Seals and United Cerebral Palsy, now known as Easter Seals UPC.
